Supreme Court Sets Deadline for Shiv Sena MLA Disqualification Case

Assembly Speaker Rahul Narvekar Ordered to Complete Hearing by December 31

New Delhi | October 30, 2023: In a significant development, the Supreme Court has taken a firm stance on the pending disqualification case of 16 Shiv Sena MLAs, including Chief Minister Eknath Shinde, under Assembly Speaker Rahul Narvekar. Chief Justice Dhananjay Chandrachud has directed that a final decision regarding the disqualification of these 16 Shiv Sena MLAs must be reached by December 31. Furthermore, the Supreme Court has set a deadline of January 31 for the verdict on the disqualification of NCP MLAs.

The Chief Justice had previously issued repeated instructions to the Legislative Assembly Speaker, urging a swift resolution of the disqualification hearings for these MLAs. The Assembly Speaker was also instructed to provide a new timetable, but this schedule indicated that it would take four to five months to complete the disqualification hearings. In response to this extended timeline, the Supreme Court has directly intervened, emphasizing that the hearings must be concluded by December 31 without fail. During this intervention, Chief Justice Chandrachud expressed his dissatisfaction with Speaker Narvekar, who had failed to make a decision despite numerous opportunities. As a result, the Chief Justice has directed the Assembly Speaker to ensure the disqualification hearings for the Shiv Sena party and the 16 MLAs in the Shinde group are concluded by the end of December.

This directive from the Supreme Court is seen as a significant challenge for Assembly Speaker Rahul Narvekar. Failure to adhere to the December 31 deadline could lead to further intervention from the Supreme Court, including setting a specific date or timeframe. All eyes are now on Vidhan Sabha Speaker Narvekar as the deadline looms.
