Former Mayor Datta Dalvi Granted Bail in Abuse Case Against CM Eknath Shinde

Uddhav Thackeray's Leader Datta Dalvi Released on Bail After Accusations of Abusing Chief Minister

December 01, 2023: In a significant development, the leader of Uddhav Thackeray’s group and former mayor, Datta Dalvi, has been granted bail by the Mulund Court. The decision comes in response to a case filed against Dalvi for allegedly using abusive language against Chief Minister Eknath Shinde. The Mulund Court released Dalvi on a bond of Rs 15,000 after he spent the last two days in Thane Jail.

The court emphasized that Dalvi’s comments did not target any specific community or group, noting the absence of derogatory statements in his remarks. Dalvi’s legal team argued that his arrest was made without prior notice under Section 41A and questioned the application of Section 153 by the police, a claim the court acknowledged without acceptance at this stage.

During the proceedings, Dalvi’s lawyer referenced the Chanda Kochhar case, drawing attention to the age and medical history of the accused. Considering these factors, the court granted bail to Datta Dalvi, imposing certain mandatory conditions.

The conditions of Dalvi’s bail include restrictions pending the conclusion of the case investigation. He is prohibited from making derogatory statements against the Chief Minister, and any provocative remarks are strictly forbidden. Cooperation with the police is mandatory, ensuring that law and order are maintained. The Mumbai Police vehemently opposed Dalvi’s bail application, but his lawyer, Sandeep Singh, presented a strong argument that led to the court’s decision to grant bail on a bond of Rs 15,000.
